You may be a member of a class that has been certified by the United States District Court for the Central District of California in Lazaro Maldonado Bautista et al. v. Ernesto Santacruz Jr et al., No. 5:25-cv-01873-SSS-BFM (C.D. Cal.
2025). On December 18, 2025, the District Court issued a ruling that certain immigration detainees may be unlawfully detained and may seek release on bond or conditional parole under 8 U.S.C. § 1226(a). Therefore, you may be entitled to request release on bond or conditional parole by immigration officers; you may also be entitled to a bond hearing upon your request to the Immigration Court. At the bond hearing, the Immigration Judge may determine that you are eligible to be released on bond while your removal proceedings are pending.

As of March 2026, federal courts are actively litigating and overturning a Trump administration policy that sought to deny bond eligibility for many detained immigrants. Key rulings, including Maldonado Bautista v. ICE, affirm that many detainees have a right to bond hearings, forcing the government to provide notice of these rights in English and Spanish.

Key Immigration Bond Developments (2026):

  • Legal Battles Over "No-Bond" Policy: A federal court in California ruled in December 2025 that the policy denying bonds to thousands of immigrants is unlawful, requiring ICE to provide hearings, reported the American Civil Liberties Union.

  • Court Orders Compliance: On Feb. 18, 2026, a court ordered the government to stop ignoring the

     ruling, ensuring that immigrants who entered without inspection (EWI) can request bond hearings

    .

  • Circuit Split: While some courts, including the 5th Circuit, have ruled that the administration has the authority to hold immigrants without bond, other district courts are opposing this as unconstitutional, creating conflicting legal standards, according to Verite News.

  • Increased Detainee Action: Due to the difficulty in obtaining bond, there has been a reported 21-fold increase in voluntary departures between January and September 2025, according to Civic Media.

  • Legislative Response: The Real Courts, Rule of Law Act of 2026 was introduced in Congress to create an independent immigration court system, noted the American Immigration Lawyers Association (AILA).

  • Minimum Bond Amounts: ICE typically sets minimum bonds at $1,500, though they can be much higher.
